Welcome to PhotoboothFinder.com (“PhotoboothFinder”, “we”, “us” or “our”).

PhotoboothFinder.com is an online platform that helps customers discover photobooth rental businesses and allows photobooth operators to create profiles, showcase their services and receive enquiries from potential customers. These Terms of Service (“Terms”) govern your use of PhotoboothFinder.com, including the use of our website, directory, business profiles and related services. By accessing or using PhotoboothFinder.com, you agree to these Terms.

1. About PhotoboothFinder

PhotoboothFinder is a directory and discovery platform. We connect customers looking for photobooth services with independent photobooth rental businesses (“Operators”). PhotoboothFinder is not a photobooth rental company and does not itself provide the photobooth services advertised by Operators. Unless expressly stated otherwise, PhotoboothFinder is not a party to any agreement between a customer and an Operator. Any booking, quotation, contract, payment, cancellation, refund or other arrangement between a customer and an Operator is solely between those parties.

2. Operator profiles and information

Operators may submit information to PhotoboothFinder for publication on their business profile, including:

Business name and contact details
Business descriptions
Photobooth types and features
Packages and services
Prices and pricing information
Availability information
Service areas
Photographs, videos and galleries
Links to websites and social media profiles
Other information relating to their business and services

Operators are solely responsible for the accuracy, completeness and legality of all information they submit or cause to be displayed on PhotoboothFinder.

PhotoboothFinder does not guarantee that information supplied by Operators is accurate, complete, current or reliable. In particular, PhotoboothFinder does not guarantee the accuracy of:

Prices
Package details
Availability
Equipment specifications
Service areas
Business descriptions
Offers or promotions
Customer reviews or other Operator-supplied information

Prices displayed on PhotoboothFinder may be indicative, starting prices, promotional prices or otherwise subject to conditions specified by the Operator.

Customers should always confirm pricing, availability, package details and other relevant terms directly with the Operator before making a booking or payment.

3. No guarantee or endorsement of Operators

The presence of an Operator on PhotoboothFinder does not constitute a guarantee, certification, recommendation or endorsement of that Operator, except where PhotoboothFinder expressly states that a particular profile or business has been verified. Where we identify a profile as “verified”, this means only that we have carried out the particular verification process described by PhotoboothFinder. It does not constitute a guarantee of the Operator’s services, quality, reliability, financial position, licensing, insurance, pricing or legal compliance.

PhotoboothFinder does not guarantee that an Operator will:

Perform a booking;
Be available on a particular date;
Provide the equipment or services advertised;
Charge the price displayed on PhotoboothFinder;
Meet a customer’s expectations; or
Comply with an agreement made with a customer.

4. Contracts between customers and Operators

PhotoboothFinder does not enter into contracts with customers for the rental or provision of photobooth services unless expressly stated otherwise. Any agreement for photobooth rental or related services is made directly between the customer and the relevant Operator. PhotoboothFinder is not responsible for disputes arising between customers and Operators, including disputes concerning:

Bookings
Payments
Deposits
Cancellations
Refunds
Availability
Service quality
Equipment
Damage
Delays
Non-performance
Pricing
Misrepresentation
Customer satisfaction

Customers should direct such matters to the relevant Operator.

5. Operator responsibility

By submitting information to PhotoboothFinder, an Operator confirms that:

The information provided is accurate and not misleading to the best of the Operator’s knowledge.
The Operator has the right and authority to provide the information to PhotoboothFinder.
The Operator complies with all laws and regulations applicable to its business and services.
The Operator will keep its profile reasonably accurate and up to date.
The Operator will not submit unlawful, fraudulent, defamatory, misleading or otherwise inappropriate content.
The Operator will not use PhotoboothFinder to promote services that the Operator is not legally entitled to provide.

Operators are responsible for updating or correcting information when it becomes inaccurate or outdated.

6. Images, photographs and other media

Operators may upload photographs, videos, logos, graphics and other visual material (“Media”) to their PhotoboothFinder profile.

By uploading or submitting Media, the Operator represents and warrants that:

The Operator owns the Media or has obtained all necessary rights, licences and permissions to use it;
The Operator has the right to upload the Media to PhotoboothFinder;
PhotoboothFinder’s publication and use of the Media as permitted by these Terms will not infringe the copyright, trademark, privacy, publicity, personality or other rights of any third party;
Where people are identifiable in the Media, the Operator has obtained any permissions or consents required for the intended use and publication of the Media;
The Media does not contain unlawful, defamatory, misleading or otherwise prohibited material.

PhotoboothFinder does not independently verify the ownership or licensing status of Media uploaded by Operators.

Operators remain solely responsible for ensuring that they have all necessary rights and permissions.

Licence to PhotoboothFinder

By uploading Media to PhotoboothFinder, the Operator grants PhotoboothFinder a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, publish, adapt, resize, crop and otherwise use the Media for the purposes of operating, promoting and improving PhotoboothFinder and the relevant Operator’s listing.

This licence includes displaying Media:

On PhotoboothFinder.com;
In search results and business listings;
In promotional materials;
On PhotoboothFinder’s social media channels;
In newsletters and marketing communications;
In advertising or promotional campaigns for PhotoboothFinder; and
In other digital or promotional formats reasonably connected with the operation and promotion of PhotoboothFinder.

The licence continues for as long as the relevant Media remains on PhotoboothFinder and for a reasonable period thereafter where necessary for archival, technical or promotional purposes. The Operator remains the owner of its Media and does not transfer ownership of the Media to PhotoboothFinder.

7. Intellectual property complaints

If you believe that content displayed on PhotoboothFinder infringes your copyright, trademark, privacy rights or other legal rights, please contact us with sufficient information to identify the content and explain the alleged infringement.

Where appropriate, PhotoboothFinder may investigate the complaint and remove, restrict or disable access to the relevant content.

Operators agree to cooperate reasonably with PhotoboothFinder in investigating such complaints.

8. Indemnification by Operators

To the extent permitted by applicable law, an Operator agrees to indemnify and hold harmless PhotoboothFinder, its operators, employees and service providers from claims, damages, losses, liabilities, costs and reasonable expenses arising out of or relating to:

Information submitted by the Operator;
The Operator’s business or services;
The Operator’s relationship with customers;
A breach of these Terms by the Operator;
Alleged infringement of intellectual property rights resulting from content submitted by the Operator;
The Operator’s failure to obtain necessary rights, licences or consents for uploaded Media; or
Allegations that the Operator’s products, services or business activities violate applicable law.

This provision does not apply to the extent that the relevant claim was caused by PhotoboothFinder’s own unlawful conduct or cannot legally be excluded or transferred to the Operator.

9. Content moderation and removal

PhotoboothFinder reserves the right, but does not generally assume an obligation, to review, modify, restrict or remove content where we reasonably consider this necessary or appropriate, including where content:

Violates these Terms;
Appears to be unlawful;
Infringes the rights of another person;
Is fraudulent or misleading;
Contains malicious software;
Is abusive, defamatory or offensive;
Is irrelevant to the purpose of the platform;
Has been reported by a third party;
Creates legal or security risks; or
Otherwise interferes with the operation of PhotoboothFinder.

PhotoboothFinder may also suspend or terminate an Operator’s profile where appropriate. Nothing in these Terms limits any rights or obligations PhotoboothFinder has under applicable law regarding unlawful content or notices of alleged infringements.

10. Availability of the website

We aim to keep PhotoboothFinder available and functioning properly, but we do not guarantee that the website will always be available, uninterrupted, secure or error-free. We may temporarily suspend or modify the website for maintenance, security, technical improvements or other operational reasons.

11. Accuracy of search results and listings

PhotoboothFinder may provide search, filtering, ranking and sorting functionality. Search results may be influenced by factors such as location, profile information, relevance, completeness, verification status, popularity, commercial arrangements or other criteria. Unless expressly stated otherwise, appearing higher or lower in search results does not constitute an endorsement or guarantee of an Operator.

12. Links to third-party websites

PhotoboothFinder may contain links to websites, social media accounts or other online services operated by third parties. These links are provided for convenience. PhotoboothFinder does not control and is not responsible for the content, availability, security, privacy practices, products or services of third-party websites. When you leave PhotoboothFinder and visit a third-party website, that website’s own terms and privacy policies apply.

13. User enquiries

PhotoboothFinder may provide functionality allowing customers to contact Operators through forms, email, WhatsApp, telephone links, social media links or other communication methods. PhotoboothFinder does not guarantee that an Operator will respond to an enquiry. We are not responsible for the content of communications between customers and Operators or for the consequences of those communications.

14. Reviews and user feedback

Where PhotoboothFinder allows users to submit reviews, ratings or other feedback, users must provide information honestly and must not submit content that is fraudulent, defamatory, abusive, misleading or unlawful. PhotoboothFinder may remove or restrict reviews or feedback where permitted by law and where we consider this necessary under our policies or these Terms.

15. Limitation of liability

To the maximum extent permitted by applicable law, PhotoboothFinder shall not be liable for indirect, incidental, consequential or special losses arising from your use of the platform or your dealings with an Operator.

In particular, PhotoboothFinder shall not be responsible for losses arising from:

Incorrect or outdated Operator information;
Incorrect prices or package information;
An Operator’s failure to honour a quoted price;
An Operator’s failure to perform services;
Poor-quality or defective services;
Cancellation of a booking;
Damage to property;
Personal injury caused by an Operator or its services;
Fraud or misconduct by an Operator;
Copyright or other rights violations caused by Operator-submitted content; or
Content, services or websites provided by third parties.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law. Nothing in these Terms excludes or limits liability for intentional misconduct, gross negligence, injury to life, body or health, or any other liability that cannot legally be excluded or limited.

16. Intellectual property of PhotoboothFinder

Unless otherwise stated, PhotoboothFinder and its licensors own or control the intellectual property rights in the website, platform, branding, design, software, text, graphics and other materials created by or for PhotoboothFinder. You may not reproduce, distribute, modify, scrape, commercially exploit or otherwise use PhotoboothFinder’s proprietary materials without permission, except where permitted by law. Operator-owned content remains subject to the rights described in Section 6.

17. Prohibited use

You must not use PhotoboothFinder to:

Commit or facilitate unlawful activity;
Submit false or misleading information;
Impersonate another person or business;
Upload content that infringes third-party rights;
Upload malware or malicious code;
Attempt to gain unauthorised access to the website;
Interfere with the operation or security of the platform;
Scrape or systematically collect data from the platform without permission;
Manipulate search rankings or reviews through fraudulent means; or
Use the platform for purposes unrelated to its intended purpose.

18. Changes to the service and these Terms

We may modify, suspend or discontinue parts of PhotoboothFinder from time to time. We may also update these Terms where necessary to reflect changes to our services, legal requirements or business practices. The latest version will be published on this page.

19. Privacy

Our processing of personal data is described in our Privacy Policy. Our use of cookies and similar technologies is described in our Cookie Policy.

20. Governing law

These Terms are governed by the laws of the Netherlands, unless mandatory provisions of the law of the country in which a consumer is habitually resident provide otherwise. Where permitted by applicable law, the courts at the registered office of PhotoboothFinder shall have jurisdiction over disputes arising from these Terms. Mandatory consumer protection and jurisdiction rights remain unaffected.

21. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
